What are the different types of custody?

There are two types of custody granted: legal custody and physical custody.  "Legal custody" means the right to determine the child's upbringing including education, health care, and religious training.  Joint legal custody means that both parties have equal rights and responsibilities including the right to participate in major decisions determining the child's upbringing, including education, health care, and religious training.

"Physical custody and residence" means the routine daily care and control and the residence of the child.  Frequently, parties agree that they shall be granted joint physical custody of their children which means they both have the routine daily care and control in residence of the child.  This is structured between the parties.

The court grants the parent legal and physical custody.  Parties may agree on a parenting plan when their primary concern is to develop a parenting arrangement that will enhance the psychological well-being of their children.  They agree how the parenting of their children shall be shared, and can do so, without using labels such as "legal custody" and "physical custody."
