My husband/wife tells me I will be impoverished after I am divorced. Is this true?
In Minnesota the court makes an equitable division of the marital property of the parties without regard to marital misconduct. This means that generally speaking, marital property is divided on a 50-50 basis. Marital property includes all property acquired during the marriage by either spouse. Such property would be the equity in the homestead, all retirement savings accounts, all liquid asset accounts, the cash value of all insurance policies, the equity value of automobiles and/or recreational vehicles, etc.
Non-marital property is generally not divided between the parties but is awarded to that person who owns the non-marital property. Non-marital property includes, but is not limited to, property brought into the marriage or property devised or gifted to one of the parties by a third party during the marriage.
